The Terms & Conditions listed below apply to the rental of equipment between you as “the Renter” and us Alicante clubs2hire S.L., hereinafter referred to as “AC2H”.
2. BOOKING DEFINITIONS
2.1 - “Equipment” shall mean the golf equipment (clubs, covers, and bag) being rented.
2.2 - “The Renter” means the renter as detailed on the booking reservation form.
2.3 - “First Rental Day” and “Last Rental Day” shall mean the first and last days respectively on which the Equipment is being rented by you.
2.4 - “Rental Period” shall mean the period during which the Equipment is being rented and will commence on the First Rental Day and terminate on the Last Rental Day.
2.5 – “Booking Date”: AC2H can accept bookings made up to 12 months in advance.
2.6 – “Minimum rental duration”: The minimum Rental Period is 1 week.
2.7 – “Maximum Rental duration”: The maximum Rental Period is 6 weeks.
2.8 – “Subject to Availability”: AC2H will make all reasonable efforts to provide you with the Equipment you order. However, please note that due to unknown factors such as Equipment not being returned on time, insufficient lead time, lost, broken or stolen Equipment, etc., all of our Equipment is subject to availability. If the Equipment you desire is unavailable, we will endeavour to replace it with Equipment of the same standard that is apt to fulfil the same purpose.
3.1 - Please note that when you make your reservation, AC2H will charge your payment card for the amount due for the entire “Rental Period” at the time of making the reservation. By acknowledging these Terms and Conditions, you also authorize AC2H to charge your debit or credit card immediately and without prior notice for any amounts due plus any late, lost, stolen, broken, non-returned equipment, and for all other amounts payable under these Terms and Conditions. An additional charge will be levied for credit card payments. No additional charge will be added for debit card payments.
4. DELIVERY AND COLLECTION
4.1 - Pick-up and Return of Equipment:
Equipment shall be picked up on the First Rental Day and shall be returned on the Last Rental Day at the airport or pre-arranged location chosen.
4.2 - For clubs to be released from our pick up points clients must be present and produce their passport and order confirmation number.
5.1 - Duties of AC2H
5.1.1 - Provide the Equipment on the First Rental Day, subject to clause 2.8
5.1.2 - Ensure that the Equipment is fit for purpose
5.2 - Duties of The Renter
5.2.1 - Pay the price referred to in Clause 6
5.2.2 - Not to use the Equipment imprudently
5.2.3 - Allow AC2H to examine the Equipment at any time.
5.2.4 - Allow any urgent repairs to the Equipment
5.2.5 - Inform AC2H immediately if there is any fault or defect
5.2.6 - Return the Equipment in its initial condition on the Last Rental Day
5.3 - Repossession of Equipment: AC2H reserves the right to request the return of the Equipment or to repossess the Equipment if you do not comply with your duties as above, or if the Equipment appears to be abandoned. In the event of repossession, AC2H reserves the right to charge your payment card for the full Rental Period or for any period thereof.
6.1 - All prices shall be as listed on the website and are subject to change without notice. The prices are guaranteed for the rental associated to the confirmed booking. The prices take into account all mandatory charges and include Value Added Tax or any other local tax. AC2H’s website prices are location based for Europe and U.K. and will be automatically charged in the currency of the location detected at time of booking.
6.2 - Additional charges may be levied in the following situations:
6.2.1 - Damages & Theft: up to the limit of the Equipment’s replacement cost.
6.2.2 - Failure to Return the Equipment: failure to return the Equipment for any reason on the Last Rental Day or when requested to do so by AC2H will result in our charging your payment card the full amount of the manufacturer’s replacement cost for the Equipment, in addition to any charges for the Rental Period.
7. PAYMENT CARD
7.1 - Payment
AC2H will charge your payment card for the amount due for the entire Rental Period when you make your online booking and by accepting these Terms and Conditions you hereby authorize this charge. In addition, you also authorize AC2H to charge your payment card for any late, lost, stolen, broken, non-returned equipment in accordance with Clause 6.2 and for all other amounts payable under these Terms and Conditions.
Payment using any of the on the website mentioned cards is accepted in accordance with the limits authorised by our card issuer Stripe Inc. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1.
This is the most stringent level of certification available in the payments industry. To accomplish this, we make use of best-in-class security tools and practices to maintain a high level of security at Stripe.
8. CHANGES TO RESERVATION: MODIFICATION / CANCELLATION POLICY
8.1 - Cancellations:
You may cancel this agreement at any time by notifying AC2H by e-mail of your intention to cancel. Club rental can only be cancelled by email. Phone cancellations cannot be accepted. In the case of cancellations, the following is our cancellation policy:
A minimum charge of €10/£10 per set will apply to all cancellations. Cancellations of less than 28 days from date of pick up will result in a charge of 25% of the value of the booking. For cancellations of less than 14 days’ notice, a charge of 40% of the value of the booking will apply. For bookings cancelled less than 7 days but more than 48 hours from date of pick up, a charge of 75% of the value of the booking will apply.
No refund will apply to bookings cancelled less than 48 hours from date of pick up. Our online cancellation policy supersedes all other written Rental Agreements that may be signed at our locations.
8.2 - Unused Booking: Equipment that is scheduled to be picked up will be kept for 12 hours and then cancelled. If the golf rental equipment is not picked up, no refund will apply and no amendment will apply to any unused booking.
8.3 - Changing Bookings and Extension of Rental Period:
We will do our best to accommodate any changes that you may wish to make to your booking, including any extensions that you may wish to make to the rental period. Please note, however, that any such changes are subject to availability, particularly when requested within 72 hours or less of your First Rental Day.
9.1 - Nothing in these Terms and Conditions will affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of AC2H. You expressly acknowledge and agree that AC2H, its officers, directors, employees or representatives will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if AC2H has been advised of the possibility of such damages), resulting from the online booking.
9.2 - Neither party shall be liable for failure in its performance hereunder caused by any case of Force Majeure. Force Majeure shall be considered as any irresistible or unforeseeable event, independent of the party suffering of the case of Force Majeure, which prevents this party from fulfilling its obligations.
9.3 - You do not acquire any ownership or other interest in the Equipment.
10. CARE OF EQUIPMENT - EAGLE COVER PROTECTION
10.1 - The Renter will be responsible for the care and security of the equipment during the hire period. The equipment will be under the control of the Renter at all times from delivery to collection and the Renter shall ensure that the equipment is used safely and without risk to health, and is not used for any purpose for which it is not designed. The equipment shall not be used by any person under the age of sixteen years.
10.2 - The Renter shall be responsible for and shall indemnify AC2H against all loss or damage caused by or to the equipment from whatever cause.
10.3 - The Renter is not permitted to take the equipment to a location outside of Spain.
10.4 - The Renter agrees to pay all costs incurred by AC2H in remedying any damage or cleaning of the equipment and hire charges will continue until such rectification is complete.
10.5 - In the event of equipment failure we will use all reasonable endeavours to repair or replace the equipment with the same or similar specification within one working day and at no charge to you.
10.6 - Should the equipment failure prove to be due to the misuse, negligence or fault of the Renter or its servants, agents or associates then AC2H reserves the right to pass on the repair costs to the Hirer. Under no circumstances shall the Hirer attempt any repairs to the equipment themselves.
10.7 - Where the Eagle coverage damage & loss waiver has been purchased, the charge in respect to lost/stolen equipment shall be reduced to the excess for that club(s). The Renter’s limitations of liability published on the website.
12.1 - When you place an order on our website, you are connected to our secure server. The secure server software (SSL) encrypts all information you input. Data of the Renter’s payment card, like card number, valid period and CVC code will not be accessible for AC2H. They stay at the authorized payment service provider.
